Product Information

Although we try to keep stock information as up-to-date and accurate as possible, the prices and availability of our products is subject to change without notice. Confirmation of an order does not represent our acceptance of the order and we may cancel it at our discretion should we not be able to supply the goods. Debiting your credit card will usually mean we have the products in stock and we will ship your order shortly after, otherwise your card will be refunded.

If you would like more detailed information on the products we stock you should contact the product’s manufacturer.

PLACING ORDERS

Payment

EMale is under no obligation to ship any products ordered until payment in full has been received and we are satisfied with the order’s integrity.

Cancellation by eMale

We reserve the right to cancel any order or transaction for any reason at our own discretion. If you have already been charged for the order, you will receive a full refund.

Cancellation by You

If you wish to cancel an order, you can request cancellation by sending us a message via the customer service form. The agreement begins once we have accepted payment and after this point it is solely at our discretion whether or not an order will be cancelled.

Shipping

At present, eMale will only ship to locations within Australia. It is your responsibility to enter the correct delivery address when placing your order. If you enter an incorrect address we are not obliged to re-send the order at our expense.

While we provide expected delivery times and we do our best to deliver by this time, these times are estimates only. We will not accept liability for any damage or loss caused by a late delivery. By placing an order on the website you agree that late delivery does not constitute a breach of our agreement and does not entitle you to cancel your order.

EMale will not accept liability for loss or damage caused by items being lost, stolen or damaged after delivery has occurred.

Returns

Because of the nature of our products we do not exchange or refund goods unless they were damaged or faulty when delivered.

If the goods you received were damaged or faulty on delivery, you must return the goods within 14 days of receipt. We will then send you replacement items, via standard delivery, at no cost to you. If we no longer have the items in stock we will either refund you the original item price or, at your option, you may choose to receive a different product up to the value of the original product.

Release and Indemnity

You agree to waive any and all claims that you know have or may have in the future against eMale which relate to or are incidental to any transaction.

You agree to indemnify and hold eMale harmless from and against any and all claims, loss or expense that may be incurred by eMale which relate to or are incidental to the performance of its duties as described in these Terms & Conditions including all costs of defending itself against a claim by any other person and/or as a result of you taking any action or refraining from taking any action or instituting or defending any action or legal proceeding.

You further agree to indemnify and hold eMale harmless from any claim made by any third party due to or arising out of your use of the website, the violation of these Terms & Conditions by you, or the infringement by you, or other users of the website using your membership account, of any intellectual property or other right of any person or entity.

General

EMale was formed, and is controlled in Western Australia. All purchases are subject to the laws of the Commonwealth of Australia, and where applicable to the state of Western Australia. By using this website you submit to the jurisdiction of the courts of Western Australia and Australia and agree that any legal action will only be commenced in these forums.
